YouTube Reinstates Video That Showed Plans For Canceled Nintendo ‘Zelda’ Project

Early in December 2022, YouTube took down a Nintendo journalistic documentary from DidYouKnowGaming about a failed 2004 pitch for a Zelda Tactics game. However, in a turn of events, the video-sharing website restored the project after it found no substantial evidence of copyright infringement. This is one of the rare examples where a YouTube creator challenges a decision and succeeds.
The original documentary video was posted back in October and showcased material from a failed Retro Studios presentation to create a Legend of Zelda tactics spin-off for the Nintendo DS called The Heroes of Hyrule. The video looked at design goals and delved into why the Studio was interested in making the game.

In response to their victory, the channel tweeted, “The Heroes of Hyrule video is back up.” As a result, the video received over 20,000 views on its first day back. However, when Nintendo first issued a copyright takedown notice against the video, DidYouKnowGaming accused Nintendo of censoring journalism and hindering efforts at preserving historical records. Nintendo would have to take the YouTube channel to court to have the video removed again if it chose to instead of merely playing big brother.
DidYouKnowGaming told Kotaku that he planned to defend the video on fair use grounds and appears to have prevailed.
